The EB-5 Immigrant Investor Program is designed for investors seeking a pathway to U.S. permanent residence for themselves and qualifying family members. Investments generally begin at USD 800,000 for qualifying targeted-employment-area or infrastructure projects, and USD 1,050,000 otherwise. Regional Center projects allow you to participate in a professionally structured development while pursuing the immigration objective. Project selection is both an immigration decision and an investment decision, and we treat it as both.

The program

About the EB-5 Immigrant Investor Program

The EB-5 Immigrant Investor Program is a pathway to U.S. permanent residence through qualifying investments of USD 800,000 in eligible targeted employment areas or infrastructure projects, or USD 1,050,000 for standard investments, subject to current USCIS requirements.

EB-5 is the United States immigrant-investor category, administered by U.S. Citizenship and Immigration Services. It leads first to conditional permanent residence rather than to a temporary investor visa, which is the main reason families choose it over nonimmigrant alternatives.

Each investor must also create at least 10 qualifying full-time U.S. jobs. That job requirement sits at the centre of the program. It is what the United States asks for in exchange for the immigration benefit, and it is what your petition must eventually evidence.

There are two common structures. A Regional Center investment places your capital into a pooled, professionally structured development, and under the applicable EB-5 rules such projects may count qualifying indirect job creation. A standalone or direct EB-5 investment places your capital into your own new commercial enterprise. The structure you choose changes the form you file, the evidence you will need and the nature of the investment itself.

Two points matter from the outset. Your capital must be invested at risk, and repayment cannot be guaranteed. And the investment does not grant U.S. citizenship. Naturalisation is a separate later process under the ordinary citizenship requirements.

Benefits

Why clients choose the EB-5 program

  1. Conditional U.S. permanent residence for the investor once the immigration process is approved.

  2. A qualifying spouse and unmarried children under 21 can immigrate as derivative applicants.

  3. After conditions are successfully removed, permanent Green Card status without the EB-5 conditions.

  4. The freedom of a permanent resident to live and work in the United States, subject to U.S. immigration rules.

  5. Potential later eligibility for U.S. naturalisation under the ordinary citizenship requirements.

Is it for you

Who the EB-5 program suits

EB-5 is best suited to families seeking U.S. permanent residence who are able to document a complete lawful source and path of their investment funds. Because project selection is both an immigration decision and a private investment and securities decision, it also suits investors who are prepared to scrutinise a project the way they would any other private placement.

Main applicant

  • Seeking permanent residence in the United States rather than a temporary nonimmigrant investor status.
  • Able to place the qualifying investment amount at risk in a qualifying project.
  • Able to document the lawful source and the complete transfer path of the capital, in depth.
  • Comfortable treating project selection as an investment decision with its own due diligence.
  • Prepared to maintain the investment at risk for the required period while job creation is monitored.

Family members who can be included

Your spouse and your unmarried children under 21 can be eligible as derivative applicants. When conditions are removed through Form I-829, the family members covered by the process become permanent residents without the EB-5 conditions. We confirm exactly who in your family qualifies during your assessment.

Not the right fit

This program is not the right fit if you are looking for a guaranteed return of capital, or for a short process. Capital must be at risk, and timelines are affected by visa availability, country-of-chargeability backlogs and project execution.

Outcome

What you receive

Status and documents

Conditional U.S. lawful permanent residence, a Green Card, for the principal investor once the immigrant-visa or adjustment-of-status stage is approved. After the conditions are successfully removed through Form I-829, the family members covered by the process become permanent residents without the EB-5 conditions.

Living, working and studying

Once lawful permanent residence is obtained, your family has the general rights and obligations of U.S. permanent residents, including living and working in the United States, subject to U.S. immigration rules.

Family

Your spouse and unmarried children under 21 can be eligible as derivative applicants and can immigrate with you, rather than applying separately later.

Financial and business

A Regional Center investor is not required to personally manage day-to-day operations in the way an active entrepreneur route demands, although the investment must still satisfy EB-5 legal requirements. Regional Center projects may count qualifying indirect job creation under the applicable rules, which is why large pooled developments are a common structure.

Tax considerations

U.S. permanent residence carries U.S. tax and reporting obligations, and these begin with the status rather than with the length of your stay. Tax treatment depends on your personal circumstances and where you are tax resident. We refer you to qualified tax advisors before you commit.

Path to permanent residence or citizenship

Permanent residence without the EB-5 conditions follows approval of Form I-829, not the investment on its own. Later eligibility to apply for U.S. citizenship may arise under the normal naturalisation rules. Citizenship is not granted by the EB-5 investment itself.

Before you apply

What to know before you apply

  • The current requirements are the ones stated on this page. A qualifying investment of USD 800,000 in a qualifying targeted employment area or infrastructure project, or USD 1,050,000 for a standard investment, together with the creation of at least 10 qualifying full-time U.S. jobs per investor, all subject to current USCIS requirements.
  • Your capital must be invested at risk. Repayment cannot be guaranteed as a condition of the investment, and no one may promise you otherwise.
  • Immigration approval and investment repayment are separate risks. An approved petition does not mean your capital returns, and a successful project does not mean an approved petition. You can experience one without the other.
  • Timelines and outcomes depend on factors outside the file. Visa availability, country-of-chargeability backlogs, project execution, job creation and the evidence available at the I-829 stage can all affect the timeline and the outcome.
  • Every project deserves its own due diligence. Capital stack, senior debt, developer equity, job cushion, construction status, exit strategy and conflicts of interest should each be documented and reviewed before you subscribe.
  • Citizenship is not part of the purchase. EB-5 leads to permanent residence. Naturalisation is a separate later process with its own requirements.

Step by step

How the application works

  1. Pre-screen your eligibility

We review your immigration eligibility and the lawful source and path of your funds before anything else begins.

  2. Choose your structure

Decide between a direct EB-5 investment and a Regional Center project.

  3. Review the project independently

We work through the capital stack, the developer, the job model, the offering documents, exit assumptions and any conflicts of interest.

  4. Transfer the investment

Move the investment and any applicable project and administrative fees through the prescribed structure, preserving the full transfer trail.

  5. File your petition

Form I-526E for a Regional Center investor, or Form I-526 for a standalone investment.

  6. Obtain conditional residence

When eligible, obtain conditional permanent residence by consular processing or adjustment of status. Concurrent filing may be available in some cases.

  7. Maintain and monitor

Keep the investment at risk for the required period and monitor job creation.

  8. Remove the conditions

File Form I-829 within the statutory window.

  9. Plan the long term

After approval you remain a permanent resident. Naturalisation is a separate later process.

Government processing times change and vary by case and by category. We confirm a current, realistic timeline with you at the assessment stage and keep you updated as your file moves.

Preparation

Documents and our pre-filing review

Documents we help you prepare

Passport and civil records; tax returns; bank statements; business, sale, gift, inheritance and loan evidence; the complete transfer trail; subscription and project documents; Regional Center project materials; and the immigration forms themselves.

Our pre-filing review

Before anything is filed we work through: nationality and residence history, family composition, criminal history, sanctions and politically exposed person screening, source and path of funds, tax advice, investment and project due diligence, translations and legalisation, current government fees, and holding and exit rules.

Questions

EB-5 questions, answered

How much do I need to invest?
Generally USD 800,000 for a qualifying targeted employment area or infrastructure project, and USD 1,050,000 otherwise. Each investor must also create at least 10 qualifying full-time U.S. jobs.
Does EB-5 give me a U.S. passport?
No. EB-5 leads first to conditional permanent residence, and then to permanent residence without the EB-5 conditions once Form I-829 is approved. Later eligibility to apply for U.S. citizenship may arise under the normal naturalisation rules, but citizenship is not granted by the investment itself.
Is my investment guaranteed?
No. The capital must be invested at risk, and repayment cannot be guaranteed as a condition of the investment. Immigration approval and investment repayment are separate risks.
Can my family come with me?
Your spouse and unmarried children under 21 can be eligible as derivative applicants. After conditions are successfully removed, the family members covered by the process become permanent residents without the EB-5 conditions.
What is the difference between a Regional Center and a direct investment?
A Regional Center investment places your capital in a pooled project that may count qualifying indirect job creation under the applicable rules, and does not require you to manage day-to-day operations in the way an active entrepreneur route does. A direct or standalone EB-5 investment is made into your own new commercial enterprise. The route you choose determines whether you file Form I-526E or Form I-526.
What could delay or affect my case?
Visa availability, country-of-chargeability backlogs, project execution, job creation and the evidence available at the I-829 stage can all affect the timeline and the outcome.
How do you review a project?
Independently, and before you subscribe. We look at the capital stack, senior debt, developer equity, job cushion, construction status, exit strategy and conflicts of interest, and each project we present carries its own due diligence page.

Current EB-5 investment projects

Each EB-5 project we present has its own page on this site. On it you will find the project overview, its location, the qualifying investment amount, the project highlights, development information and images of the development itself, alongside the due diligence material that project requires. Reviewing these pages is the starting point, not the decision. Any project you consider must be assessed as an investment as well as an immigration route, and the full terms are set out only in that project's official offering documents. Speak to us before you commit to any project shown here.

Project-specific information is published only after internal verification and U.S. legal compliance approval.
